This License Agreement ("Agreement") is a legal agreement between you ("Licensee") and [Skyrocket Theme] ("Licensor") for the use of the Skyrocket Theme ("Software"). By purchasing, downloading, installing, or using the Software, you agree to be bound by the terms of this Agreement.
1. Grant of License. Licensor grants Licensee a non-exclusive, non-transferable, and limited license to use the Software in accordance with the terms and conditions of this Agreement. The license is granted solely for Licensee's own use of the Software in connection with Licensee's Shopify store. Licensee may not modify, distribute, copy, or resell the Software or any portion thereof.
2. License Restrictions. Licensee may not share, distribute, copy, resell, or otherwise make available the Software or any portion thereof to any third party without Licensor's prior written consent. Any such unauthorized use will result in immediate termination of this license and legal action against the infringing party.
3. Ownership. The Software is owned and copyrighted by Licensor. Licensee acknowledges and agrees that Licensor retains all ownership rights and intellectual property rights to the Software, and that nothing in this Agreement shall be construed as granting any rights, by license or otherwise, to Licensee except as expressly set forth herein.
4. Termination. This Agreement shall terminate automatically upon any breach of the terms and conditions of this Agreement by Licensee. Upon termination, Licensee shall immediately cease all use of the Software and destroy all copies thereof. Termination shall not relieve Licensee of its obligation to pay any fees accrued or payable to Licensor prior to termination.
5. Warranty Disclaimer. The Software is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Licensor does not warrant that the Software will meet Licensee's requirements or that the operation of the Software will be uninterrupted or error-free.
6. Limitation of Liability. Licensor shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Software, even if Licensor has been advised of the possibility of such damages.
7. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of [Australia], without giving effect to any choice of law or conflict of law provisions.
8. Entire Agreement. This Agreement constitutes the entire agreement between Licensee and Licensor with respect to the Software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties.
A valid license grants the licensee the right to use the Skyrocket Theme for a lifetime. This license is valid for use on an unlimited number of stores owned by the licensee. However, the licensee must own the stores on which the software is installed. Any transfer, assignment, or sublicensing of the license without the Licensor's written consent is strictly prohibited. The licensee may not resell, distribute, or offer the Skyrocket Theme for sale, lease, or license to any third party without Licensor's prior written consent.
We reserve the right to terminate any license agreement or usage of the theme for any customer at any point, for any valid reason we see fit. Any instance of a Skyrocket theme customer or theme holder using the theme after the license has been taken away is liable for damages for using unlicensed theme. Offenders will be blacklisted from our themes and services and penalties will be enforced. Purchasing the theme or using it is agreeing to these terms. Skyrocket Theme also reserves the right to modify or edit the code of any theme files, due to support reasons or license information concerns to protect Skyrockets best interest.
By using the Software, Licensee acknowledges that it has read this Agreement, understands it, and agrees to be bound by its terms and conditions.

Unauthorized Use of Skyrocket Theme
Anyone who uses, shares, distributes, copies, or resells the Skyrocket Theme without a valid license is engaging in unauthorized use of the Software. Licensor reserves the right to take legal action against any individual or entity that engages in unauthorized use of the Software, including but not limited to seeking injunctive relief, damages, and/or any other legal remedies available under applicable law. In addition, any license granted for the use of the Software will be immediately revoked in the event of any unauthorized use of the Software.
Have You Seen Anyone Illegally Using/Reselling/Sharing Skyrocket?
We take the unauthorized use of the Skyrocket Shopify Theme very seriously, and we rely on our customers to help us identify any such activity. If you have reason to believe that someone is using, reselling, or sharing Skyrocket without a valid license, we encourage you to report it to us immediately. To report such activity, please contact us through our website with as much information as possible, including the name and contact information of the individual or entity engaged in the unauthorized use, as well as any relevant details about the use itself. Your assistance in helping us protect our intellectual property is greatly appreciated.
We reserve the right to modify or change these terms at any point in time and do not need to notify the customer. Customers hold the responsibility to ensure they’re up to date with these terms.
